Copyright
All online tracks that you find on Trackquencher.com are copyrighted. The non-exclusive tracks are the property of the licensor and/or Trackquencher.com associated producers.
Trademarks
The logo and domain of Trackquencher.com are copyright properties of Trackquencher.com. These cannot be used without the authorized permission of the owner. You can contact the webmaster in order to obtain rights and permission, if required!
Product Usage
All the online beats available at trackquencher.com can be used by your for yourself or your client in order to create tracks however these cannot be put for sale or distribution via a CD, website or any other format. You cannot resell these tracks or beats to any third party through CDs or pen drives, in such cases, Trackquencher.com reserves the rights to terminate your membership. In case the terms mentioned above are not respected, you will lose the right to any legal access as well as Trackquencher.com reserves the right to pursue a legal case with a punishment of the highest possible order for this offence. The licensee is also not allowed to post the tracks in a form where it is downloadable for others or can be easy distributed to other people. This can be considered to be a copyright infringement under the stated laws of the US as well as other countries. The online tracks available are without any kind of warranty in an “as is” condition.
As a user, you have to acknowledge the fact that Trackquencher.com does not share any responsibility in the kind of track quality or degree of music. You are supposed to make a judgment as per your understanding of the material rather than holding Trackquencher.com responsible. Also you have to understand that any information or warranties provided by sites being advertised cannot be responsibilities of Trackquencher.com. We are not responsible for any information, claims, warranties or services provided by them or any damages that occur. You can subscribe to their products or services at your own discretion.
Non Exclusive License
As per the non-exclusive license, you only lease the rights to use the online beats. The tracks continue to remain the property of Trackquencher.com. You are not allowed to resale, distribute or transfer the tracks in any format to any other person. Any activity that is non-permissible as per the terms mention will be considered as violation of the copyright laws.
With the leasing rights you can use the beats for any one project, on the web, CD or for demos. In case you want to resell or distribute the beats for more than that you have to opt for the business license. You can contact us to get more information on the same. The following are some important terms regarding the non-exclusive license that are to be kept in mind.
1. Music ownership: All online tracks that you find on Trackquencher.com are copyrighted. The non-exclusive tracks are the property of the licensor and/or Trackquencher.com associated producers.
2. Non Exclusivity: The licensor provides the tracks for non exclusive usage by the licensee, there can be ‘n’ number of licensees for the same track.
3. Inability to obtain license: In case you are not able to obtain a license from Trackquencher.com before use of a track, you will have to beat legal obligations. The violation of a copyright law as per the US laws can lead to a $30000 fine.
4. Credits: The licensee is bound to give the licensor the credits on all commercial productions, Cds or any other form of material distributed to the masses. The credits can be listed as: Original backing track(s) copyrighted to Trackquencher.com and/or Trackquencher.com associated producers.
5. Indemnity: The Licensee agrees to indemnify, protect, and hold Licensor harmless from any and all actions, causes of action, claims, demands, costs, liabilities, expenses and damages arising out of or in connection with any claim that the Tracks furnished by under this License constitutes an infringement of any confidential information, trade secret, patent, copyright, trademark, trade name, or other legal right of any third party.
6. Jurisdiction: The agreement hereby shall be read as per the legislative rules of the State Of Pennsylvannia.
Exclusive License
With the exclusive rights for a track, the licensee can use the beats for any and all commercial purposes. Such rights are provided only to a single licensee and upon sale the track is also removed from the list on the website.
Custom License
The custom beats are made by us for clients looking for exclusive beats created in a certain way. You will have to pay upfront fees which will be 50% of the total charge and fill the form in order to begin the project.
Royalty Free: It precisely means that there are no royalty charges associated with the selling of the tracks. It surely does not mean non-copyrighted material. The copyrights for the royalty free tracks are with the seller or the sellers.
You can download beats from various genres, rap beats, hip hop beats and others that you would require. You can choose between exclusive and non exclusive rights depending on the requirement and the budget.
